International Commercial Arbitration
1. Pursuant to the arbitration clause embedded in the Master Services Agreement, all disputes arising therefrom shall be resolved under the ICC Rules of Arbitration in Singapore.
基本サービス契約に定められた仲裁条項に基づき、本件に起因する一切の紛争は、シンガポールにおけるICC仲裁規則に従って解決されるものとします。

2. The claimant contends that the respondent's unilateral termination of the contract constituted a material breach that engendered substantial consequential damages.
申立人は、被申立人による一方的な契約解除は重大な契約違反であり、それによって相当な範囲の派生損害が生じたと主張しています。

4. The doctrine of separability ensures that an arbitration agreement remains valid and enforceable even if the underlying commercial contract is subsequently found to be void.
分離可能性の原則により、たとえ基礎となる商業契約自体が無効と判断されたとしても、仲裁合意は有効かつ執行可能なものとして存続することが保証されます。

5. Counsel for the respondent argued that the claimant had failed to mitigate its losses, thereby precluding recovery of damages that could have been avoided through reasonable measures.
被申立人側の弁護士は、申立人が損失の軽減措置を怠ったため、合理的な対応によって回避できたはずの損害賠償は認められないと主張しました。

6. The arbitral award, once rendered, is binding on the parties and is enforceable in over 160 contracting states pursuant to the 1958 New York Convention.
仲裁判断は、一度下されると当事者を拘束し、1958年のニューヨーク条約に基づき160を超える締約国で執行可能となります。

証人尋問は、口頭証拠排除原則によって審理の対象から明確に除外されている契約締結前の交渉に関するものであったため、証拠として採用されないと判断されました。
